Specification of the authorisation After you have filled in and sent the online application form you will receive an acknowledgement of receipt of your application. The trademark attorneys of Georg Pintz & Partners forward the application to the Local Partners, who handle and check the applications and file them to the national Trademark Office. Please note that neither Georg Pintz & Partners nor the local representative conduct a search for previous conflicting trademarks unless you order such a service. We suggest that you should conduct a similarity search using Total EU Search, our online professional search system. This service is considered an additional service, please check the respective business conditions for details. Please note that even if the mark chosen by you is of a distinctive character there may be other reasons why it cannot be registered as a trademark. If our office or any of our Local Partners find that the mark you have chosen is not suitable for trademark registration, the trademark application will be filed in all countries except in the country where the local representative deemed the mark unsuitable for filing. In such cases 50% of the respective service fee is refundable to you along with the official fee if you withdraw your application in that country. The refund shall be paid by bank transfer and the costs of the bank transfer shall be deducted from your refund. We provide services according to the rules of legal representation. This is based on the cooperation of the parties. It comes from the nature of this legal relation that the office is obliged to handle your case professionally and carefully. In case of an application for registration the final decision is made by the authorities therefore our office and our local partners have no responsibility in this regard. It is our policy that we do not accept cases where there is a conflict of interest in respect of our existing clients. In such cases (e.g. at an opposition against our clients) the office refuses the authorization request and refunds all effected payments. In case you feel that your matter is not treated appropriately, please turn directly to the manager of the head office. We thoroughly investigate any complaint. The operation of Georg Pintz & Partners is under the rules of Law No. XXXII of 1995 (HU) on patent attorneys. The Local Partners are under the jurisdiction of their respective country. Service Fees and Official Fees for each country The basic service fee is in general EUR 145, which includes 1 or 3 classes depending on the country. In addition to the basic fee there is a fee of EUR 95 for each additional class of goods or services. The basic official fee of the trademark application depends on the regulation of the respective country (for more information see the Schedule of Fees or the Fee calculator). If your application covers more than 1 or 3 classes then an extra official fee is also applicable for each additional class according to the Schedule of Fees. We charge EUR 45 for disbursements after each country involved. Please note that these are only the filing fees and that there may be other fees as well in the country you choose that are charged by the local representative directly, e.g. the registration fee (please check the Schedule of Fees). A bank handling fee is also charged (3 %). Total Costs The total filing cost shall be calculated according to the Schedule of Fees. You may estimate the costs of online services with the Fee calculator. Georg Pintz & Partners handles the application after filing according to the common rules of the applications with legal representation. It charges the fees according to its discount Schedule of Fees (EUR). These fees are to be paid via bank transfer (if not paid by bank card). If due to any miscalculation discrepancy occurs between the costs displayed on the ”Pay & submit” page and the prices listed in the Business Conditions, the prices listed in the Business Conditions shall prevail. Any information on the official fees shall be considered an estimation and if the estimate is lower than the official fee then the actual fees apply. Georg Pintz & Partners and its Local Partners charge you correspondingly for each official fee which is due before any national patent office at filing or later. Please note that the total amount of the fees charged by the application does not include the additional costs that may arise in connection with the registration of the trademark after the application has been filed. Such additional costs are the following: - the fees and expenses in connection with receiving and forwarding the official search report of the respective trademark office, - the fees and expenses in connection with any opposition procedure (legal representation at hearings, written notices in support of the trademark), - the cost of the certificate of registration. All additional costs are charged by the Local Partners according to their own schedule of fees. We provide you with a brief summary of these potential or obligate additional costs but the exact and detailed list of fees and other costs are provided by the Local Partners directly. Please contact the Local Partners if you have any questions regarding the additional costs.
Accomplishment of the mandate for applications After having received the full documentation and payment our office or the respective Local Partner processes the matter. The application is filed as soon as possible, generally within 8 days, taking into consideration the complexity of the case. Please note that the full documentation includes the duly signed Power of Attorney (PoA) too, therefore the Local Partner cannot usually file the application until the PoA has arrived to its office. Make sure to mail the PoAs in time, preferably directly after submitting your application. A “Follow up” page is available for your convenience to be able to monitor the actual status of your case. The trademark applications in countries other than Hungary are prepared and filed by our Local Partners. Georg Pintz & Partners is only a transmitting agent mediating their service for you. Georg Pintz & Partners is not responsible for any default, delay or error caused by our Local Partners. If such an event arises, please contact us. Your complaints concerning Local Partners are also mediated by Georg Pintz & Partners. Annulment of an agreement The provision of services is regulated by the rules of legal representation and mandate agreements. Generally Georg Pintz & Partners accept mandates where one of the languages of the procedure is English and there is no conflict of interest in the representation. The mandate can be revoked by you any time however any costs incurred up to that time (either by Georg Pintz & Partners or its Local Partners) shall be charged to and paid by you. If you revoke or partially withdraw your application and our Local Partner has not filed your application then 50% of the respective service fee is refundable to you along with the official fee (provided that the official fee has not been paid by the Local Partner). The refund shall be paid by bank transfer and the costs of the bank transfer shall be deducted from your refund. Mandates given by using online forms are processed within a short period of time. There is no possibility for any reimbursement of fees once the application is forwarded to the authorities since the mandate for filing is completed and the authorities do not reimburse the official fees. It is not possible to amend the applications unless it is allowed by the applicable law. Our office reserves the right to refuse or to suspend any mandate requests or terminate an accepted mandates with 15 days notice. Overpayments shall be refunded if any. Payment via bank card You can pay with VISA, VISA Electron, Mastercard (EC/MC), and JCB bank cards. The payment is effected on the secure site of the bank. When submitting an application on the SSL (Secure Socket Layer) interface you are connected directly to our Bank (K&H). K&H Bank Hungary is the affiliate of KBC Bank Belgium. Georg Pintz & Partners does not receive or handle any information relating to your card, our office receives only a short message about the payment from the bank. The bank has a secure 128-bit encrypting key to protect the communication channel. VeriSign certified K&H bank to use this 128-bit key, based upon which it ensures the application of SSL-based encryption. This encryption method is applied in 90 % of today’s global e-commerce. The browser program used by you (Internet Explorer or Netscape Navigator) encrypts the cardholder’s data before transmission. This means that the information given by you gets to the destination in an encoded form and no unauthorised party is able to interpret or to use it.
