GUIDELINES
General Information
Here you can file design applications, or renew designs for RCD-s to the OHIM (Office for Harmonization in the Internal Market) with legal representation and electronic service of Georg Pintz & Partners Patent and Trademark Attorneys, European Union. Representative is compulsory for applicants outside the European Union, and advisable within the Union. After having filled in and sent the forms you will receive an acknowledgement of receipt of your application. The patent attorneys of Georg Pintz & Partners handle and check the applications and within a few days forward them to the OHIM. You can save a lot of money through this e-service. Georg Pintz & Partners takes care of all the formalities required to register your design.
Filing
You can choose only a professional surface in English, although individual applicants may submit their applications as well. Beginners unfamiliar with design classification are suggested to consult with our head office in written. In this case applications are filed and invoiced in classical way.
Fees
New application
The basic service fee is EUR 95, which includes one design. For additional designs you must pay a fee of EUR 55 for each. The official fee is EUR 230, and for additional designs up to 10 designs EUR 115 each, from 11 designs EUR 50 each. The service fee of publication is EUR 50, for additional designs you must pay a fee of EUR 10 for each. The official fee of publication is EUR 120, and for additional designs up to 10 designs EUR 60 each, from 11 designs EUR 30 each. We charge in advance for reporting on registration (refusal), checking document and forwarding certificate EUR 120 and for additional designs EUR 10 for each. The disbursements are EUR 45. In general there are no other fees. You can pay with bank cards, or via bank transfer.
Renewal
The basic service fee is EUR 55. The official fee is EUR 90 for the first renewal (from 2007) at each design. Taking over the representation costs EUR 80 if any. We charge for reporting on renewal and checking document EUR 60. The disbursements are EUR 45. Georg Pintz & Partners offer band discount at multiple renewals from the service fees. At 3-10 designs the basic service fee is EUR 35, taking over the representation costs EUR 40 if any. Reporting on renewal, checking document costs EUR 30, the disbursements are EUR 15. From 11 designs the basic service fee is only EUR 15, taking over the representation costs EUR 20 if any. Reporting on renewal, checking document costs EUR 20, the disbursements are EUR 5. You can pay with bank cards, or via bank transfer. Please note that the first renewal period begins in the second half of 2007.
Invalidation
The OHIM does not carry out search for earlier designs and does not examine the earlier rights during the registration procedure of Community Design. Since existence of earlier right or earlier identical unregistered design anywhere in the world may be the ground for refusal, the holder of the earlier right may invalid the registration. The procedure is inter-partes: it happens between the holder and the opposing party. The invalidity division of the OHIM organises the procedure. Please note that not only the application of invalidation but also the argumentation and evidences must be filed at the same time. The publication of the granted designs should be observed by the potential applicant. Design watching helps this monitoring. The basic service fee is EUR 595, the official fee is EUR 350. The disbursements are EUR 45. As the procedure moves on, further costs may occur. We charge at hourly rates (180 EUR/hour).
Assignment, Change of address/name
OHIM acknowledges any changes regarding the owner or applicant after recordal of the new data. Please use the menu “Assignment” even if it is only a change of address. The basic service fee is EUR 85. Taking over the representation costs EUR 80 if any. The disbursements are EUR 45 in general. The official fee is EUR 200 at the assignment. At change of data there is no official fee. Change of name must be considered often as an assignment. It is possible to request the recordal of more than one design in one authorization in case the same persons are involved. Georg Pintz & Partners offer band discount in these cases. At 3-10 designs the basic service fee is EUR 45, taking over the representation costs EUR 40 if any, the disbursements are EUR 15. From 11 designs the basic service fee is only EUR 15, taking over the representation costs EUR 20 if any, the disbursements are EUR 5. Over 5 designs there is no further official fee.
